Welcome to www.hokenoptics.com (the “Site”). These Terms of Service (“Terms”) govern your use of the Site and purchases from HØKEN, operated by Swedrest Logistics Sp. z o.o. (“HØKEN,” “we,” “us,” or “our”). By accessing the Site and/or purchasing from us, you agree to these Terms and our Privacy Policy.

This Site is operated by Swedrest Logistics Sp. z o.o.. By visiting the Site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms, including any additional policies referenced herein or available by hyperlink. These Terms apply to all users of the Site.

We may update these Terms from time to time by posting a revised version on the Site. Your continued use of the Site following any changes constitutes acceptance of the updated Terms.

ONLINE STORE TERMS

By using the Site, you confirm that you are at least the age of majority in your place of residence, or that you have obtained the consent of a parent/guardian for any minor dependents using the Site.

You agree not to use our products or Site for any illegal or unauthorized purpose and not to violate any laws, including intellectual property laws. You must not transmit malware, viruses, or any harmful code. Violation of these Terms may lead to immediate termination of your access to the Service.

DISCOUNT CODES

By submitting your email, you may receive discount codes which can be applied at checkout under the following conditions:

Codes cannot be combined with other discounts or products already on sale.
Newsletter welcome codes (10%) are valid for 7 days from receipt and require.
Additional code-specific terms may apply as stated at issuance.

We reserve the right to decline or cancel orders where a code was used fraudulently or in breach of these Terms.

PRICING AND PAYMENT

Prices, taxes, and shipping fees are displayed at checkout and may change without notice. We currently accept Shopify Payments only, including supported card payment methods listed at checkout.

By placing an order, you confirm that you are authorized to use the payment method provided. We may refuse or cancel orders for reasons including suspected fraud, pricing errors, or stock issues.

SHIPPING, DELIVERY & RISK OF LOSS

We ship within the European Union only.

Free shipping applies to all orders EU-wide.

Delivery timelines provided at checkout are estimates, not guarantees. Risk of loss and title transfer to you upon delivery to the address provided.

If a carrier returns an order as undeliverable (wrong address, failed delivery attempts, etc.), we will contact you to arrange re-shipment. Additional shipping charges may apply.

RETURNS & REFUNDS — STANDARD PRODUCTS

We offer a 30-day return policy for all orders within the EU, subject to the conditions below:

Free Returns

Free returns are available ONLY within Poland.

Paid Returns

For all other EU countries, the customer is responsible for return shipping costs unless the product is defective or incorrect.

Return Conditions

Returned items must be:

unused
in original condition
with all original packaging, accessories, and tags

Missing packaging may reduce refund eligibility or incur deductions.

Refund Method

Refunds are processed to the original payment method only. Bank processing times may vary.

Exchanges

Exchanges are processed as store credit or replacement items where applicable.

Your statutory rights (including the EU 14-day withdrawal right) remain unaffected.

WARRANTY

All HØKEN products include a 2-year warranty against manufacturing defects.

Covered:

Manufacturing faults in frames, materials, or components
Defects present upon delivery (must report immediately with photos)

Not Covered:

Normal wear and tear, including scratches
Damage from misuse, neglect, accident, or exposure to chemicals
Heat damage, warping, saltwater damage
Items altered by third parties
Lost or stolen goods after delivery (orders marked “Delivered” are complete)

If a defect is confirmed, we will repair or replace your product at no cost, including shipping. Warranty claims provide replacement only unless required by law.

ACCURACY OF BILLING & ACCOUNT INFORMATION

We reserve the right to refuse or cancel orders at our discretion, including suspected fraud or reseller activity. You agree to provide accurate, complete, and up-to-date information for purchases. You must promptly update your details, including email and payment information, to ensure successful fulfillment.

OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to third-party tools or websites strictly “as is” and “as available.” We do not control these services and are not responsible for any issues arising from their use. Third-party websites operate under their own terms and policies.

USER CONTENT (COMMENTS & FEEDBACK)

If you submit ideas, suggestions, reviews, or other content (“Comments”), you grant us a worldwide, royalty-free, nonexclusive right to use, edit, publish, translate, and distribute such Comments without obligation to compensate you or maintain confidentiality.

You represent that your Comments do not violate intellectual property rights, contain harmful content, or transmit malware. You are solely responsible for any Comments you submit.

PERSONAL INFORMATION

Your submission of personal information through the Site is governed by our Privacy Policy.

ERRORS, INACCURACIES & OMISSIONS

Occasionally, information on the Site may contain typographical errors or omissions relating to product descriptions, pricing, promotions, shipping fees, or availability. We reserve the right to correct these issues at any time without prior notice, including after an order has been submitted.

You are prohibited from using the Site or its content:

To the fullest extent permitted by EU law, HØKEN and Swedrest Logistics Sp. z o.o. shall not be liable for indirect or consequential damages, including loss of profit, data, or revenue.

Where exclusions are not permitted by law, liability shall be limited to the maximum extent allowable.

INDEMNIFICATION

You agree to indemnify and hold harmless HØKEN, Swedrest Logistics Sp. z o.o., and affiliates from claims arising from your breach of these Terms or violation of applicable law or third-party rights.

SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

TERMINATION

These Terms remain in effect unless terminated by you or us. We may terminate your access without notice for violation of these Terms. Obligations incurred prior to termination continue to apply.

ENTIRE AGREEMENT; NO WAIVER

These Terms and any policies posted on the Site constitute the entire agreement between you and us. Failure to enforce any provision does not constitute a waiver.

GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of Poland, where Swedrest Logistics Sp. z o.o. is registered.
Disputes shall be resolved in the competent courts of Poland, unless mandatory EU consumer protection rules apply.
